I believe the trick was on the concentration of alcohol (70-80%) and I believe the ones currently in production aren't near that number.

The trouble with absinth (and the reason it was banned) is that the brands then used contained thujone (a true brain-eater). Today it can be removed with supercritical CO₂.

I should mention though, that the thujone is probably not the actual ingredient that makes absinthe damaging to the brain. Fusel oils and certain herbs apart from wormwood are more likely ingredients. According to wikipedia, the EU lifted the ban on absinthe in 1998 (it lasted a bit longer than The Prohibition obviously).
